01
Build a factual operating snapshot
Gather the signed lease and amendments, current rent ledger, deposit records, service agreements, and unresolved maintenance requests. Separate collected rent from scheduled rent and identify arrears without treating them as guaranteed future income. Remove tenant identity documents and account numbers from anything shared for an initial review. A prospective buyer can begin with a summary and request sensitive records through an agreed secure channel when appropriate.
02
Plan the transaction around existing occupancy
Identify who communicates with occupants, what access has been agreed, and what possession outcome you are proposing. Do not promise vacant possession, issue notices, or change locks simply because you want to sell. Have counsel review the applicable requirements and contract terms. Compare selling occupied with other options using actual costs and lawful timelines. Any deposit transfer, prorated rent, property-management handoff, or repair responsibility should be addressed by the transaction professionals before closing.
